Welcome to L’LUXE. The terms “we,” “us” and “our” refer to L’LUXE. L’LUXE operates this online store and website, including the related information, content, features, tools, products and services made available through it (collectively, the “Services”).

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with the policies referenced within them, describe the terms that apply when you access or use our Services or purchase from L’LUXE.

Please read these Terms carefully. By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service and the policies applicable to your use of the Services.

Nothing in these Terms is intended to exclude, restrict or replace any consumer right or remedy that cannot legally be waived.

1. Access & Account

By using the Services, you represent that you are legally capable of entering into transactions through our website in accordance with the laws applicable to you.

When using the Services or placing an order, you may be required to provide information including your name, email address, billing information, payment information and shipping address.

You agree that the information you provide is accurate, current and complete and that you have the right to provide that information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

2. Products & Product Information

L’LUXE carefully curates Previously Owned authentic designer goods, Ready-to-Wear, footwear, jewelry, fashion accessories and specially sourced pieces.

We make reasonable efforts to present our merchandise accurately through product descriptions, photographs, measurements, condition information and other details.

Colours, textures, proportions and other visual characteristics may appear differently depending on photography, lighting, screen settings and the device used to view our website.

Previously Owned merchandise may naturally show signs of previous use, age, handling or storage. Customers should review all photographs, measurements, condition information and product details before purchasing.

Product descriptions, availability and other information may be corrected or updated when necessary.

3. Authenticity

L’LUXE is committed to offering authentic designer merchandise.

Previously Owned designer products are sourced through established professional suppliers and are reviewed according to the authentication procedures applicable to the item and source.

For eligible brands and items, authentication is performed using Entrupy. Following your purchase, L’LUXE emails you the electronic Entrupy Certificate of Authenticity associated with your eligible piece.

If a customer believes that a Previously Owned designer item is not authentic, L’LUXE may request credible written documentation from a qualified professional authentication service in order to investigate the claim.

L’LUXE is an independent retailer and is not affiliated with, endorsed by or sponsored by the designer brands whose products are offered through our website unless expressly stated otherwise.

4. Product Availability

All merchandise is subject to availability. Certain products may be individually sourced, specially sourced or available only in limited quantities.

Availability may change before an order or supplier availability is confirmed.

We reserve the right to modify, discontinue or remove merchandise from the website at any time.

If an ordered product becomes unavailable before fulfilment, L’LUXE will contact the customer and provide appropriate options, which may include an alternative item or cancellation and refund.

5. Orders & Order Acceptance

When you submit an order, you are making an offer to purchase the merchandise identified in your order.

An automated order confirmation acknowledges that your order has been received but does not necessarily constitute final acceptance of the order.

L’LUXE reserves the right to refuse, limit or cancel an order where reasonably necessary, including in circumstances involving product unavailability, payment issues, suspected fraud, pricing or listing errors, or other circumstances affecting our ability to fulfil the order.

If an order is cancelled after payment has been collected, the applicable amount will be refunded to the original payment method unless otherwise required by law.

6. Prices, Payment & Billing

Prices, discounts and promotions may change without notice. The price applicable to an order will generally be the price displayed when the order is submitted, subject to correction of errors and applicable law.

Any applicable shipping charges, taxes or other charges will be presented or handled according to the information provided through our website, checkout and applicable policies.

You agree to provide accurate and complete purchase, billing and payment information and to promptly update information where necessary.

By submitting payment information, you represent that you are authorized to use the selected payment method.

7. Shipping & Delivery

Processing and delivery times vary depending on the type of merchandise purchased.

For Previously Owned designer items, please allow approximately 14 days for shipping and delivery.

Ready-to-Wear orders are typically prepared within 3–5 business days, with delivery typically taking 10–15 business days after order preparation.

Delivery times are estimates and may vary because of destination, carrier operations, customs processing, weather conditions, public holidays, seasonal demand or circumstances outside the reasonable control of L’LUXE.

8. Customs, Duties & Import Charges

For international orders, customs requirements, duties, taxes and other import charges may vary by destination country.

Where applicable, customers are responsible for charges assessed by local customs or authorities unless otherwise expressly stated.

9. Returns, Refunds & Statutory Rights

Return eligibility is governed by our Returns, Refunds & Statutory Withdrawal Policy and any additional conditions clearly disclosed for the applicable merchandise.

Unless an item is identified as Final Sale, a discretionary return request must generally be submitted within 14 days of delivery.

Eligible discretionary returns approved under the L’LUXE Return Policy may be subject to a 10% return/restocking fee, where permitted by applicable law.

Mandatory consumer rights, including any applicable statutory cancellation, withdrawal, warranty or other rights, take precedence over the L’LUXE discretionary return policy.

10. Order Cancellations

Because merchandise may be individually sourced or processed shortly after an order is submitted, cancellation cannot be guaranteed after an order has been placed.

Customers wishing to request cancellation should contact L’LUXE as soon as possible.

Nothing in this section restricts a statutory cancellation or withdrawal right available under applicable law.

11. Intellectual Property

The Services and their content, including text, product descriptions, graphics, logos, photographs, images, videos, branding, design elements and website presentation, are owned by L’LUXE or the applicable licensors or content owners and are protected by applicable intellectual property laws.

Content from the Services may not be reproduced, distributed, modified, republished, commercially exploited or otherwise used without appropriate authorization.

Designer names, trademarks and logos appearing in connection with merchandise remain the property of their respective owners. Their appearance on our website does not imply affiliation, sponsorship or endorsement.

12. Optional Tools & Third-Party Services

The Services may provide access to tools, applications, payment providers, delivery services, integrations or functionality supplied by third parties.

Third-party services may be governed by their own terms and privacy practices. L’LUXE does not control the independent operation, availability or policies of third-party providers.

Your use of third-party services is subject to any applicable terms imposed by those providers.

Our Services may contain links to websites or resources operated by third parties.

L’LUXE is not responsible for the content, availability, accuracy, privacy practices or operation of third-party websites. Customers should review the applicable terms and policies before using or purchasing through a third-party service.

14. Relationship with Shopify

L’LUXE is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and L’LUXE.

Shopify provides the ecommerce infrastructure supporting our store but is not the seller of merchandise offered by L’LUXE.

15. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy requirements.

Because our store is hosted by Shopify, certain information may also be processed by Shopify and other service providers used to operate the store, process transactions and provide the Services.

16. Feedback, Reviews & User Content

If you submit reviews, comments, suggestions, photographs or other content to L’LUXE, you represent that you have the right to provide that content and that it does not violate applicable law or the rights of another person.

Where you submit content for publication or promotional use, you grant L’LUXE a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute that content in connection with operating, improving and promoting the Services, subject to applicable law.

L’LUXE may remove user-submitted content that is unlawful, misleading, abusive, defamatory, infringing or otherwise inappropriate.

17. Errors, Inaccuracies & Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, availability, promotions, shipping charges or delivery information.

L’LUXE reserves the right to correct errors, update information and, where reasonably necessary and permitted by applicable law, cancel or modify an affected order.

You may use the Services only for lawful purposes.

You must not use the Services to:

• Violate applicable laws or regulations
• Infringe intellectual property or other legal rights
• Transmit malicious code, viruses or harmful technology
• Engage in fraud, impersonation or misleading activity

Obligations and provisions that by their nature should continue after termination will remain in effect.

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

L’LUXE does not guarantee that access to the website will always be uninterrupted, secure or error-free.

Nothing in this section excludes or limits any warranty, legal guarantee or consumer protection that cannot legally be excluded or limited.

21. Limitation of Liability

To the fullest extent permitted by applicable law, L’LUXE and its service providers will not be liable for indirect, incidental, special or consequential losses arising from use of the Services.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited, nor does it restrict any mandatory consumer right or remedy.

22. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities or claims resulting from your material breach of these Terms, violation of applicable law or infringement of another person’s rights.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary. The remaining provisions will continue in effect.

24. Waiver & Entire Agreement

A failure by L’LUXE to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms and the policies incorporated or referenced within them constitute the agreement governing your use of the Services, subject to any mandatory rights or obligations imposed by applicable law.

25. Governing Law

These Terms of Service are governed by the laws of the Province of Quebec and the applicable federal laws of Canada, subject to any mandatory consumer protection rules or jurisdictional rights that apply to a particular customer or transaction.

26. Changes to These Terms

L’LUXE may update these Terms of Service from time to time.

The current version will be posted on this page with the applicable update date. Where applicable law requires additional notice or consent for a change, those requirements will apply.

27. Consumer Rights

These Terms are intended to operate alongside applicable consumer protection legislation.

Nothing in these Terms is intended to exclude, restrict, waive or replace a statutory consumer right or remedy that cannot legally be excluded.

If any provision of these Terms conflicts with a mandatory consumer protection law applicable to a particular transaction, the mandatory legal requirement will prevail.
